West Virginia Medical Waste Requirements and Regulations

Large Quantity Generators (Shippers) of more than 50lbs of Regulated Medical Waste per month are required to obtain a permit from West Virginia Department of Health and Human Services.  See this guidance document for further details.

Small Quantity Generators (Shippers) of less than 50lbs of Regulated Medical Waste per month are required to have a Spill Kit with:

  • 2  Red bags 
  • Pair of gloves
  • Face mask (surgical type or equivalent)
  • Pair of goggles or equivalent eye protection
  • Absorbent material capable of absorbing 1/2 gallon of liquid
  • Spray can of disinfectant effective against TB
  • These items should be stored in a heavy container with a tight fitting lid (such as a plastic tote)
  • A disposable dust pan and broom are recommended for sweeping up sharps

Small Quantity Generators (Shippers) have a maximum of 30 days of storage time.
The designated area should be access controlled, kept in a non-putrescent state, with floor drains discharging directly to sanity sewers or containment systems. There should be no trash compacting or carpets/floor coverings with open seams.

Training is required for employees involved with packaging, labeling, storage, or treatment of infectious medical waste.
