Oregon Medical Waste Requirements and Regulations

We care about your business needs and ensure that we are in compliance with Federal and State of Oregon regulations. Oregon’s medical waste disposal regulations are managed by the Department of Environmental Quality.

See Oregon Administrative Rules 459.396 to 459.405 for regulations on infectious wastes. See Chapters 340-093-0030, 340-093-0190 by the Department of Environmental Quality for Solid Waste regulations. Complete details on state requirements can be found by contacting the Oregon Department of Environmental Quality.

In Oregon, Infectious Waste falls into any of 4 categories:

  • Pathological waste
  • Biological waste
  • Cultures and stocks
  • Sharps

Infectious waste is segregated from other wastes by separate containment at the point of generation.

  • Enclosures used for waste storage shall be secured to prevent access by unauthorized persons and marked with prominent warning signs
  • Pathological waste, biological waste and cultures/stocks shall be treated or disposed of within 7 days of generation, unless it is refrigerated (between 33 and 48 F) or frozen (less than 32 F).
  • Refrigerated or frozen infectious waste may be stored 30 days prior to treatment or disposal
  • Prior to treatment, sharps may be stored indefinitely IF in a leak proof, rigid, puncture resistant container which is taped closed or tightly lidded to prevent loss of the contents

Generators (shippers) that produce 50 lbs or less of infectious waste in any calendar month are exempt from the storage times and temperatures requirements.
