New York Medical Waste Requirements and Regulations

New York’s medical waste storage, treatment, and destruction regulations are issued by the Department of Environmental Conservation (NYSDEC). The New York Department of Health (NYSDOH) regulates how that waste is managed by a generator facility. Details on State requirements may be found by reviewing the regulations and the NYSDEC & NYSDOH websites. 

  • Cultures and stocks of infectious agents, culture dishes and devices used to transfer, inoculate or mix cultures that are contaminated with biological agents that are potentially infectious to humans 
  • Pathological waste (human) excluding teeth and contiguous structures of bone and gum 
  • Body fluids removed during surgery, autopsy or other medical procedures
  • Specimens of body fluids and their containers, and discarded materials saturated with body fluids other than urine 
  • Human blood and blood products, including their components
  • Liquid blood and saturated flowing blood and blood products (except feminine hygiene products)
  • Sharps, whether used or unused, including accepted residential sharps 
  • Animal waste known to be contaminated or inoculated with infectious agents including animal carcasses, body parts, body fluids, blood or bedding

Medical waste storage areas must have prominent identifying signage and be equipped to prevent unauthorized access by people or vermin, be regulated in temperature, as well as be properly ventilated and sufficient size to allow separation of waste types.

Medical waste may be stored on-site for a maximum of 30 days, unless the generator produces less than 50 pounds per month; if under 50 pounds per month, a generator may store medical waste up to 90 days. Sharps may also be stored for up to 90 days unless they reach the fill line or become odorous first.
